These Terms of Service (“Terms”) are a legal agreement between you and Grid City VR LLC (“Grid City VR,” “we,” “us,” or “our”). They govern your use of the website at gridcityvr.com (the “Site”), your booking of experiences through the Site or our booking partner, and your interactions with Grid City VR through digital channels.

Please read these Terms carefully. By using the Site, booking with us, or communicating with us through digital channels, you agree to these Terms. If you do not agree, do not use the Site or book with us.

‍

Your visit to our physical venue is additionally governed by our on-site liability waiver and venue house rules, which you will be asked to review and sign on-site. Those on-site documents are separate from these Terms and control for anything covered specifically by them.

1. Who can use the Site and book with us

‍

You must be at least 18 years old to book experiences or create an account on the Site. If you are under 18, a parent or legal guardian must book on your behalf and accept these Terms for you. Certain experiences or areas of the venue have their own age restrictions, including age restrictions related to alcohol service, which we enforce on-site.

By using the Site, you represent that you have the legal authority to enter into these Terms.

2. Bookings, payments, and pricing

‍

Bookings. All bookings are subject to availability and confirmation. A booking is confirmed only when you receive a confirmation from us (by email or on-screen) and any required deposit or payment has been processed.

Pricing. Prices shown on the Site are in U.S. dollars and exclude applicable taxes and fees unless stated otherwise. We may change prices, promotions, and offerings at any time. The price that applies to your booking is the price shown at the time of confirmation.

Payments. Payments are processed by our third-party payment processor. By booking, you authorise us and our processor to charge the payment method you provide for the total booking amount, including taxes and fees.

‍

Errors. If a price or product is displayed incorrectly due to a typographical, pricing, or system error, we reserve the right to cancel or refuse the affected booking, even after confirmation, and to refund any amount already charged.

3. Cancellations, rescheduling, refunds, and no-shows

‍

Specific cancellation, rescheduling, and refund terms for each experience are shown at the time of booking and in your booking confirmation. Those terms form part of these Terms and apply to your booking. The general principles below apply to all bookings.

‍

• Cancellations and rescheduling by you. You may request to cancel or reschedule your booking by contacting us at info@gridcityvr.com or through your booking confirmation. Eligibility for a refund or rescheduling depends on the terms shown at the time of booking and how close to the start time the request is made.
• No-shows. If you do not arrive by the start time of your booking and have not cancelled in advance, your booking may be forfeited without refund.
• Late arrivals. If you arrive late, we will do our best to accommodate you within your original time slot, but we cannot guarantee the full duration of the experience or a refund for time missed.
• Changes by us. We may need to cancel, shorten, or reschedule a booking due to technical issues, safety concerns, staffing, equipment availability, or circumstances outside our reasonable control. If we do, we will offer you a reschedule or a refund of amounts paid for the affected portion of the booking.
• Private events, group bookings, and packages. These may have their own cancellation and deposit terms, which we will provide at the time of booking. Those terms control for those bookings.

All refunds will be issued to the original payment method. Processing times vary by payment provider.

4. Venue rules, safety, and conduct

‍

Our venue includes free-roam VR arenas, racing simulators, an escape room, a tap wall, and a bar and lounge area. Some of these activities involve physical movement, head-mounted displays, motion platforms, sound, light, and other sensory elements. Participation carries inherent risks.

‍

By booking and attending, you agree to:

• Follow all staff instructions, posted signage, and safety briefings at all times.
• Sign our on-site liability waiver before participating in VR, simulator, or other activity-based experiences. Participation is not permitted without a signed waiver.
• Disclose any medical condition, injury, pregnancy, or impairment that may affect your safe participation. We reserve the right to restrict participation on safety grounds.
• Not participate under the influence of alcohol or drugs to a degree that impairs your ability to participate safely. We may refuse service at our discretion.
• Respect our staff, other guests, and the venue. Harassment, threatening behaviour, vandalism, theft, or violation of our house rules will result in removal from the venue without refund and may result in a permanent ban.
• Comply with all applicable laws while on the premises.

Alcohol is served only to guests of legal drinking age with valid identification, and only in accordance with Colorado liquor laws and our licences.

‍

5. Photography, video, and marketing content

‍

We regularly capture photos and video inside our venue for marketing and social media. By entering the venue, you acknowledge and agree that:

• You may appear in photos or video captured by us or by our authorised partners.
• We may use, reproduce, edit, publish, and distribute that content on our Site, social-media channels, advertising, and other marketing materials, in perpetuity and without further compensation.
• If you do not want to appear in marketing content, tell a staff member on arrival and we will do our best to accommodate you (for example, by not featuring you in photos we publish).

If you post content about Grid City VR on your own channels and tag us, or submit content to us, you grant us a non-exclusive, royalty-free, worldwide licence to repost, reshare, and use that content across our channels with credit to you where reasonably possible. You represent that you have the rights to any content you tag us in or submit to us.

6. User communications and reviews

‍

You may send us messages through the Site, email, SMS, or social media, and you may leave reviews on third-party platforms. When you communicate with us:

• You agree not to send unlawful, threatening, harassing, defamatory, or deceptive content.
• We may moderate, remove, or not respond to content that violates these Terms or platform rules.
• Reviews should reflect your genuine experience.

7. Intellectual property

‍

All content on the Site — including the Grid City VR name, logo, graphics, photography, video, text, layout, code, and design — is owned by or licensed to Grid City VR and is protected by copyright, trademark, and other laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Site without our prior written permission, except:

• For your own personal, non-commercial use
• To share links to public pages on the Site through normal social-media sharing

We grant you a limited, revocable, non-exclusive licence to access and use the Site for its intended purpose.

8. Prohibited uses of the Site

‍

You agree not to:

• Use the Site in any way that violates applicable law
• Attempt to gain unauthorised access to the Site, its servers, or any connected systems
• Scrape, data-mine, or use automated tools to access the Site except as explicitly permitted
• Interfere with or disrupt the Site, its security, or its operation
• Use the Site to transmit malware, viruses, or other harmful code
• Impersonate Grid City VR or any other person
• Use the Site to harass, defraud, or harm others

9. Third-party services and links

‍

The Site integrates with and links to third-party services, including our booking partner, payment processor, social-media platforms, and analytics providers. We are not responsible for third-party services or their content, and your use of them is governed by their own terms and policies.

10. Disclaimers

‍

The Site and the information on it are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.

Descriptions of our experiences on the Site are provided for general information. Actual experiences may vary based on equipment, staff, other guests, and circumstances at the venue.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law.

11. Limitation of liability

‍

To the fullest extent permitted by law:

• Our total aggregate liability to you arising out of or relating to these Terms, the Site, or any booking made through the Site is limited to the greater of (a) the amount you paid to Grid City VR for the specific booking giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
• We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, even if we have been advised of the possibility of such damages.

The limitations in this Section 11 apply to the Site, these Terms, and any booking made through the Site. Your participation in activities at the venue is separately governed by our on-site liability waiver, which you sign on arrival.

12. Indemnification

‍

You agree to indemnify, defend, and hold harmless Grid City VR, its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms, (b) your violation of any law or the rights of a third party, or (c) your misuse of the Site.

13. Governing law and dispute resolution

‍

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles.

‍

Any dispute arising out of or relating to these Terms or the Site that cannot be resolved informally will be brought exclusively in the state or federal courts located in Colorado, and you consent to the personal jurisdiction and venue of those courts.

14. Changes to these Terms

‍

We may update these Terms from time to time. When we do, we will post the updated Terms here and update the “Last updated” date above. If the changes are material, we will provide additional notice. Your continued use of the Site or the venue after the effective date of the updated Terms constitutes acceptance of the updated Terms.

15. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy and any booking-specific terms, are the entire agreement between you and Grid City VR about the Site and your bookings.

‍

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

‍

No waiver. Our failure to enforce any provision is not a waiver of that provision.

‍

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
